  Wenn bei einem Fahrzeug ein Konstruktionsfehler vorliegt, kann der Käufer auch dann vom Kaufvertrag zurücktreten, wenn es sich um einen Gebraucht-wagen handelt. So musste der Autohändler für einen Schaden am Zylinder-kopf bei einem gebrauchten Jeep Cherokee aufkommen, der bei diesem Modell häufig auftritt.
In dem vor dem Thüringer Oberlandesgericht verhandelten Fall (Urteil vom 19.01.2006, AZ: 1 U 846/04; ADACJUR Dok.Nr. 70318) hatte der Käufer ein fünf Jahre altes Fahrzeug mit einer Laufleistung von circa 85 000 km erwor-ben. Nach knapp 10 000 gefahrenen Kilometern wurde ein Riss am Zylinderkopf festgestellt. Der Gerichtsgutachter bestätigte, dass der Motor nicht überhitzt wurde und dass bei der betroffenen Modellreihe eine Vielzahl solcher Defekte bei Kilometerständen zwischen 80 000 und 120 000 km auftreten.
Außerdem lag dem Gericht eine Herstellerinformation vor, dass der Zylinderkopf mittlerweile, aufgrund bisher aufgetretener Probleme, neu entwickelt wurde. Für die Richter stand zweifelsfrei fest, dass die Zylinderköpfe nicht dem Stand der Technik entsprachen und es sich nicht um normalen Verschleiß handelte. Nicht jede Funktionsbeeinträchtigung führt zu einem Mangel im Sinne der gesetzlichen Sachmängelhaftung. Für normalen Verschleiß muss der Verkäufer nicht haften.
