 Stuttgart (ACE) 20. Oktober 2004 – Schwere Zeiten für Raser, Drängler und Rotlichtignoranten. Verkehrssünder können ihre Strafpunkte in der so genannten Flensburger Verkehrssünderkartei nicht mehr mit Hilfe juristischer Tricks tilgen.
Wie der ACE Auto Club Europa am Mittwoch in Stuttgart mitteilte, gilt bereits seit Anfang September ein neues Verfahren. Danach blockieren weitere Verkehrsverstöße vom Tag an, an dem sie begangen wurden, die Tilgung vorhandener Punkte. Bislang musste der Bußgeldbescheid oder das Urteil erst rechtskräftig sein, um die Tilgungsfrist auszusetzen. "Diese Hintertür, durch die Verkehrssünder schlüpfen konnte, ist mit dem Justizmodernisierungsgesetz jetzt fest verriegelt worden", sagte ACE-Verkehrsrechtexperte Volker Lempp. Nach seinen Worten konnte mit Hilfe eines versierten Anwalts und des Einsatzes von Rechtsmitteln der Vorgang so lange verzögert werden, dass noch vor Eintragung des neuen Verstoßes der alte bereits getilgt war. Auf diese Weise war es möglich, weitere rechtliche Sanktionen abzuwenden, weil die mitunter entscheidenden Punkte das Konto nicht mehr belasteten.
Haben sich 14 Punkte angesammelt, kann bei Verweigerung des dann fälligen Aufbauseminars der Führerschein entzogen werden; bei 18 Punkten ist der Führerschein grundsätzlich weg. Laut ACE befinden sich im Flensburger Verkehrszentralregister derzeit über sieben Millionen Verkehrssünder, fast 55 Prozent davon bekamen Punkte wegen Geschwindigkeitsübertretungen. 121. 000 Kraftfahrer haben 14 und mehr Punkte auf dem Flensburger Konto und müssen um ihren Führerschein bangen.
Die jetzt vorgenommene Schließung des juristisch gangbar gewesenen "Notausgangs" ist laut ACE dem Gesetzgeber offenbar so wichtig gewesen, dass er nicht einmal die bei derartigen Gesetzgebungsverfahren übliche Übergangsfrist vorgesehen hat. Das in weiten Teilen noch unbekannte 1. Justizmodernisierungsgesetz ist Ende August verkündet und am 6. September 2004 in Kraft gesetzt worden. Trotz der veränderten Verfahrensweise zur Aussetzung der Tilgungsfrist, hat sich an der "Zeitschiene" nichts geändert. Die Tilgungsfrist beträgt bei Bußgeldentscheidungen weiterhin zwei Jahre, bei Verurteilungen in Verkehrsstrafsachen fünf Jahre, und zehn Jahre bei Alkoholstraftaten und bei Entziehung der Fahrerlaubnis.
